Workshop Liability Waiver

TL;DR SUMMARY

By purchasing a ticket or participating in this workshop, you acknowledge that this is a hands-on event involving sharp cutting tools, natural plant materials, and inherent risks. You voluntarily assume all risks of injury or damage, agree to follow all instructor safety rules, and release both the event organizer and the host venue from any legal claims or liability. You also grant permission for event photography and confirm that you have the legal authority to accept these terms for yourself or any attending minors. Please read the full agreement below for complete details.

By purchasing event tickets and checking the required boxes you agree, “I have read and agree to the [terms] on behalf of myself and all attendees in my order.”

 

ACCIDENT WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT

READ CAREFULLY: THIS DOCUMENT IS A BINDING LEGAL CONTRACT THAT RELEASES CERTAIN LEGAL RIGHTS AND ABSOLVES THE ORGANIZER AND VENUE FROM LIABILITY FOR INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH. BY PURCHASING A TICKET, SIGNING, OR PARTICIPATING, YOU ASSUME ALL INHERENT RISKS.

This Participant Accident Waiver, Assumption of Risk, Release of Liability, and Indemnity Agreement (“Agreement”) is entered into by the participant (or parent/legal guardian if participant is under 18) (“Participant”) in favor of Thunderstruck Bonsai LLC (the “Company/Organizer”), alongside the Host Venue—defined as any venue, facility, brewery, café, property owner, landlord, or location hosting the specific event, workshop, or date for which Participant purchased a ticket or is attending (the “Host Venue”)—and their respective officers, directors, members, owners, employees, agents, contractors, volunteers, affiliates, successors, and assigns (collectively, the “Released Parties”).

1. VOLUNTARY PARTICIPATION & DESCRIPTION OF ACTIVITIES

Participant voluntarily chooses to participate in hands-on instructional workshops, pop-up events, and craft activities organized by Company and hosted at the designated Host Venue location for the purchased event date (the “Event”). Participant acknowledges that activities include, but are not limited to: instruction, handling, and operation of sharp cutting tools (such as shears, pruning scissors, wire cutters, concave cutters); handling live botanical specimens, soil, wire, ceramics, and decorative materials; and participating in events within active commercial, hospitality, retail or beverage premises.

2. EXPRESS ASSUMPTION OF RISK

Participant fully understands and expressly acknowledges that participating in hands-on tool workshops carries inherent risks that cannot be completely eliminated regardless of the care taken by the Released Parties. Specific risks include, but are not limited to:

  • Sharps & Tool Hazards: Severe cuts, lacerations, puncture wounds, pinches, eye injuries, or infection resulting from slips or improper use of shears, scissors, knives, wire, or related cutting instruments.
  • Environmental & Premises Hazards: Slipping, tripping, or falling on wet, polished, or uneven floors; exposure to natural allergens, plants, dirt, or organic dust.
  • Food & Beverage Hazards: Ingestion of food, water, or alcoholic beverages available at or near the venue premises.
  • Participant Conduct: Negligent, careless, or improper actions of other event attendees or participants.

PARTICIPANT KNOWINGLY, FREELY, AND VOLUNTARILY ASSUMES ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES OR OTHERS, AND ASSUMES FULL RESPONSIBILITY FOR PARTICIPATION.

3. EXPRESS RELEASE OF LIABILITY & COVENANT NOT TO SUE

To the fullest extent permitted by Florida law, Participant hereby releases, waives, discharges, and covenants not to sue the Released Parties from any and all claims, demands, liabilities, rights, causes of action, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to any personal injury, bodily injury, illness, disability, death, or property damage sustained by Participant while participating in, preparing for, or traveling to/from the Event, WHETHER ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

4. INDEMNIFICATION & HOLD HARMLESS

Participant agrees to defend, indemnify, and hold harmless each of the Released Parties from and against any and all claims, suits, demands, liabilities, damages, judgments, losses, and legal costs (including attorneys’ fees) arising out of or resulting from Participant’s presence, conduct, participation in the Event, or breach of this Agreement. If Participant or anyone acting on Participant’s behalf brings a claim against any Released Party, Participant agrees to pay all legal fees and costs incurred by the Released Party in defending such claim.

5. TOOL SAFETY RULES & PARTICIPANT CONDUCT

Participant agrees to strictly follow all safety rules, guidelines, and verbal instructions provided by Company instructors and venue staff. Participant agrees to inspect tools before use, handle cutting tools with reasonable care, refrain from operating tools while intoxicated or impaired, and immediately notify staff of any tool defect or injury.

6. MEDICAL AUTHORIZATION & EMERGENCY CARE

Participant certifies that Participant is physically fit and has no medical condition that would prevent safe participation in the Event. In the event of an injury or sudden illness, Participant authorizes the Released Parties to obtain emergency medical treatment on Participant’s behalf and agrees to assume sole financial responsibility for all medical costs, transportation, and treatment incurred.

7. PHOTOGRAPHY & MEDIA RELEASE

Participant grants Company and Host Venue the irrevocable, royalty-free right to record, photograph, and video Participant during the Event and to use Participant’s image, likeness, and voice in promotional materials, websites, social media, and advertising without further compensation or approval.

8. MINOR PARTICIPANT PROVISION (FLORIDA STATUTE § 744.301)

If Participant is under eighteen (18) years of age, the undersigned parent or legal guardian certifies that they have the legal authority to sign this Agreement on behalf of the minor child. Pursuant to Florida law, the parent/guardian expressly agrees that all terms of this Release, Assumption of Risk, and Indemnity apply equally to the minor participant.

9. GOVERNING LAW, VENUE & SEVERABILITY

This Agreement shall be construed and governed strictly in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to this Agreement shall be instituted exclusively in the state or federal courts located in [INSERT COUNTY, e.g., Pinellas County], Florida. If any provision of this Agreement is held invalid or unenforceable, the remaining terms shall continue in full legal force and effect.

10. ELECTRONIC PURCHASE ACKNOWLEDGMENT (DIGITAL CHECK-OUT)

Participant acknowledges and agrees that checking the mandatory agreement box, purchasing an event ticket online, or presenting a digital pass constitutes an electronic signature under the Florida Electronic Signatures in Global and National Commerce Act (E-SIGN) and Florida Statute Chapter 668, creating a legally binding and enforceable contract.

BY SIGNING BELOW OR CHECKING THE REQUIRED TERMS BOX AT CHECKOUT, I CONFIRM THAT I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, AND AGREE TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
